Terms of Service

1. Who we are

This website is operated by [LEGAL NAME / TRADING NAME], trading as Auntie Wainwright's Antiques, [REGISTERED ADDRESS], Cork, Ireland ("we", "us"). You can reach us at [CONTACT EMAIL] or through the enquiry form on any product page. By placing an order you agree to these terms.

2. Our products

We sell antiques and curiosities. Every item is unique, previously owned and sold as a one-off. Age-related wear consistent with an item's history is not a defect; material flaws are described and photographed as accurately as we reasonably can. Photographs form part of the item description. If you are unsure about an item's condition, size or provenance, please ask before buying.

Items marked "contact for price" are offered by enquiry only and are not part of the online ordering process until we agree a price with you in writing.

3. Orders and payment

Placing an order constitutes an offer to purchase. A contract is formed when we confirm the order by email. Because every item is one of a kind, an item may occasionally be sold in the shop before your online order completes — if that happens we will cancel and refund your order in full.

Payment is taken in euro (EUR) at checkout and processed by Stripe. We never see or store your card details. Prices include VAT where applicable — as second-hand goods, many of our items are sold under the VAT margin scheme, in which case no VAT is shown or deductible on the invoice. [CONFIRM VAT TREATMENT WITH YOUR ACCOUNTANT]

4. Delivery

Delivery costs and timescales are agreed per order — antiques often need specialist packing or courier services, and we will contact you after purchase to arrange the most suitable option. [DESCRIBE YOUR STANDARD SHIPPING ARRANGEMENTS AND ROUGH TIMESCALES] Risk in the goods passes to you on delivery.

5. Right of withdrawal (EU consumers)

If you are a consumer in the EU buying at a distance, you may withdraw from the purchase within 14 days of receiving the item, without giving a reason, under the Consumer Rights Directive (2011/83/EU) and the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013. To exercise this right, contact us within the period and return the item within 14 days of telling us. Return the item in the condition you received it; you are liable for any diminished value beyond what was needed to examine it. Return shipping is at your cost unless the item is faulty or not as described. We refund within 14 days of receiving the item back, using your original payment method.

6. Faulty or misdescribed items

Your statutory rights under the Sale of Goods Acts and the Consumer Rights Act 2022 are unaffected by anything in these terms. If an item arrives damaged or materially differs from its description, contact us within a reasonable time. Since replacement is rarely possible for one-off items, we will typically arrange a return with a full refund including delivery costs — or a repair or partial refund if you prefer to keep the item.

7. Accounts

You may create an account to speed up checkout and track orders. Keep your password confidential — you are responsible for activity under your account. Provide accurate contact and delivery details; we are not responsible for failed deliveries caused by incorrect information. We may suspend accounts used fraudulently or abusively.

8. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited by law. Otherwise, our total liability in connection with an order is limited to the price paid for that order. We are not liable for delays or failures caused by events outside our reasonable control.

9. General

These terms are governed by the laws of Ireland and the Irish courts have jurisdiction (consumers retain any protections of their home country's law). If any clause is found invalid, the rest remain in force. We may update these terms; the version in force when you order applies to that order. The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr.
